"The Artist" Refers to Vintage Japes, and or the business Paronomasia Expedition, the seller.
"The Client" Refers to the buyer.
"The Product" Refers to the merchandise, Art, or content that been created for the service.
1. WORK AND PAYMENT.
1.1 Schedule. The Artist will begin work on and the work is ongoing. This Contract can be ended by either Client or Artist at any time, pursuant to the terms of Section 6, Term and Termination.
1.2 Payment. The Client will pay the Artist at the "sketch phase", if the client fails to pay the artist, the contract will be dropped.
1.3 Support. The Artist will not provide support for any deliverable once the Client accepts it, unless otherwise agreed in writing.
1.4 Refunds The Artist does not offer any refunds. Once the Client accepts the product past its "Sketch phase".
1.4a: If the product is downloadable content, no refunds can be granted.
1.4b: If the client "Charges back" then they no longer own the rights to the product, and may not use it in any sort of form. They also give the Artist express permission to disclose their name to the public, and share their usernames on any platform the artist uses.
2. OWNERSHIP AND LICENSES.
2.1 Client Owns All Work Product. The client owns the finished product and may use it in Non commercial ways. The client may pay for a "Commercial fee" if they wish to use the work for commercial products. (See 2.3)
2.2 Artist's Use Of Work Product. The artist has the right to post the product in they're portfolio, and on social media platforms. The client may pay for a "Privacy fee" (see 2.4)
2.3 Commercial Usage The client may not use the product commercially. If they wish to do so, the Client may discuss a commercial fee, this fee will be dependent on the use.
2.3 a) Assets purchased through Unity Asset store has no need for this fee. Refer to Unity Asset store policy, and Licensing.
2.4 Privacy fee If the Client pays the Privacy fee, then the Artist may not post the product in their portfolio, or on any social media platforms.
The Artist reserves the right to change the TOS at any time, and or add on to it.
